CONDITIONS OF SALE



These Terms of Sale apply to all online purchases by a consumer from the DISTRI BAGAGES website at www. lipault.com (hereafter, the “Site”).

Commercial customers should contact us for the terms and conditions that are applicable to them.


1. Acceptance of the Terms of Sale

You are advised that any sale on the Site can only be concluded after noting and accepting the terms of sale. Any orders made on the site necessarily imply full acceptance by the customer of these contractual conditions. This is confirmed by ticking the box “I have read and agreed the Terms of Sale” and by clicking the “Proceed” button.

Terms of sale may be subject to change. You are advised that the applicable terms of sale are those that were posted on the Site on the day of purchase.




2. Product Descriptions

The essential characteristics of each product are described on each product page.
The information provided includes the model, size, volume, colour, weight and material.
The measurements listed are the exterior measurements of each product, which may vary slightly from the actual product.

You can also refer to the photographs illustrating each product, although it should be noted that there may be minor differences with the actual product delivered.




3. Opening an Account

When placing an order on the Site for the first time, you must register with the Site and provide contact information such as your full name, postal address (for invoice and delivery) and email address.

By registering on the Site, you confirm that you are aged 18 or over and that you have full legal capacity to enter into contractual relations with us.

You also confirm that the details you have submitted are accurate and up-to-date. Under no circumstances can we be held responsible for the consequences of inaccurately submitted information.

You also agree to inform us in writing of any changes to your details (in particular to your address, telephone number or email address, etc).

When subscribing to the Site, you must chose an ID and password which will allow you to be identified by the Site’s servers for the purposes of placing an order and for future visits to the Site.

You are responsible for keeping this ID and password safe and you agree not to reveal this confidential information to any third party. Any instructions we receive using your correct ID and password will be considered confirmed by you and we cannot be held accountable for their fraudulent use.




4. Placing an Order and Payment

To place an order, you must click on “Add to Basket” underneath the article that you wish to buy.

You will be able to check and, if necessary, revise your order and total order price in the section “My Shopping Basket”.

You signal your confirmation by clicking on the “Confirm” button.

Payment is due on placing your order.

We accept the following methods of payment: :

- credit/debit card,
- cheque,
- bank transfer.

If paying by credit or debit card, you will be directed to the secure site of your card provider to confirm payment.

To make a payment by card, you will need to provide the following information: :

- card number,
- three digit security code on the reverse of the card,
- expiry date.

You confirm that you are the cardholder and that you hold all rights necessary for the use of the card.

To make payment through the exterior site of your card provider, you must agree to the terms of use of that site.

If paying by cheque or bank transfer, please be advised that the order will not be complete, and the goods will not be sent out, until the effective transfer of funds into our account has been confirmed

Once your order has been confirmed, you will be sent a confirmation email to the address which you provided when opening an account with us.




5. Prices

Product prices (excluding postage and packaging) are listed in Euros, including all relevant taxes. All orders are payable in Euros, regardless of the location where the order was placed or the delivery destination.

Sales prices are valid as long as they are posted on the Site.

Import duties vary by country and depending on the size and number of products ordered. You will be informed of the delivery costs before the final confirmation of your order.




6. Ownership

Please note that all products remain property of Lipault until full payment has been received.

7. Delivery

We agree to deliver our products to the countries listed on the “Delivery” page.

Deliveries are effected by external providers, namely La Poste and Chronopost depending on the chosen option, as explained at Delivery.

You should check the state of your product on delivery, and inform the delivering company of any damage or missing products.
We agree to deliver your order within 30 days from the date of purchase. Average delivery times are listed at Delivery.

Our delivery obligations shall be fully discharged as soon as you have received your package. The risk of theft, loss, or damage to the products is then transferred to you.

Products offered are limited by availability. Information on the availability of each product can be found on the relevant page on the Site as well as on the order form.

If it transpires that a product is not, in fact, available, we will inform you immediately by email, and offer a new delivery time. If this delivery time is not acceptable to you, you may choose to retract your order and you will be refunded the amount the paid for the unavailable item.




8. Your Right of Retraction

Within a period of seven days from the date of delivery, you may return any ordered goods without explanation or penalty payments, although you must cover the costs of the return shipment.

If the seven-day period expires on a Saturday, Sunday or French public holiday, it will be extended until the next working day.

This period may be extended in exceptionable circumstances, such as due to serious medical emergencies

You are advised that your right of retraction allows testing of the product, but not its use. You will lose your right of retraction if the product shows signs of use.

9. Guarantee

All products purchased through the Site are guaranteed against any manufacturing faults for a period of three years from the date of purchase.

This guarantee covers manufacturing faults only, and does not include the effects of normal use, incorrect use or mistreatment, failure to follow the instructions for use, lack of maintenance or inappropriate use of the product. In addition to this commercial guarantee, you are also protected by the provisions of Articles L.211-1 to L211-14 of the French Consumer Code.

Article L211-4 of the Code provides that:

“The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery.
He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefore or had it carried out under his responsibility.”

According to Article L211-5: :

“To conform to the contract, the product must:

1° 1. Be suitable for the purpose usually associated with such a product and, if applicable:

- correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model;
- have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling;

2° 2. Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.”

Due to the restraints of internet commerce, we are not able to accept special requests and cannot agree to provide you with products intended for a special use. We cannot, therefore, be held responsible if the products supplied do not fulfil the particular objective for which you intended them to be used. You are advised that we do not guarantee that “Cabin” bags will be accepted by airline companies on board as carry-on luggage. We conform to the recommendations of the IATA (International Air Transport Association), which state that the total dimensions of the bag must not exceed 115cm to be accepted on board as carry-on luggage.

In accordance with Article L211-12 of the Consumer Code, “action resulting from lack of conformity lapses two years after delivery of the product.”

You are also protected against hidden faults.

According to Article 1641 of the French Civil Code “a seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.”

Article 1648, Paragraph 1, specifies that “the action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice.”




10. Data Storage and Proof of Purchase

Both parties agree that, in case of litigation concerning the interpretation or implementation of these Terms of Sale, the electronic data we hold shall have conclusive force. Information necessary to constitute proof of the agreement that we make with you shall be held for a period of ten years.

11. Applicable Law

The contract concluded between DISTRI BAGAGES and the consumer is subject to French law, regardless of the nationality of the consumer or the country where the product was ordered or delivered.
